Intellectual Property Mediation

An Italian SME (licensor) licensed the IP Rights (copyright) over a TV show to an Argentinean producer (licensee). The agreement included a mandatory mediation clause.  The licensee went bankrupt and failed to pay royalties.

Lessons learned: 

Intellectual Property Rights conflicts are not always to be solved by going to Court.

Introduce ADR clauses in order to avoid unnecessary expenses.

The IP was solved by an expert on the matter, which made easier to redirect the situation in the right direction.

Mediation helped to solve the conflict between the parties while maintaining good trade relations.

The final user did not ever noticed the dispute –since the proceeding was kept secret- and the prestige of the two companies was not affected at all.
