Chilean Draft Law proposal on Industrial Property for patents, trademarks and designs

Last October 2018, Chile proposed a new draft of the Chilean Law on Industrial Property.

According to this proposal, it will be possible to apply for a provisional patent giving 12 months to proceed with the final application. Furthermore, this draft introduces new fees and allows any patent application, in any technical field, to access to a supplementary protection, subject to certain conditions.

In trademarks, it is foreseen to have non-traditional trademarks introduced in the final text. In addition, a new criminal offence will be introduced in the Penal Code for cases of counterfeiting.

With regards to industrial designs, a new accelerated registration will be created and the term of protection will be extended from 10 to 15 years.
