The Latin America IPR SME Helpdesk (hereinafter “the Helpdesk”) is a project co-founded by the European Commission (Hereinafter “the Commission”) and under the supervision of the Executive Agency for Small and Medium Enterprises (Hereinafter “EASME”) under the COSME Programme (2014-2020) and implemented by a group of public and private entities (provide details) (hereinafter the Consortium).


The Helpdesk is a offers a range of free services providing practical, objective and factual information aimed to help European SMEs to understand business tools for developing IPR value and managing risk.


Use of the services


The use of the services is allowed subject to the compliance of the terms contained herein, our Privacy Notice as well as any applicable European and/or National Law.


You may not assign, sub-license or otherwise transfer any of your rights and obligations in the terms to any other person.


Users’ account


You can use part of the services of the Helpdesk without the need of a user account. However, to enjoy the full range of services of the Helpdesk and to improve your users’ experience you may need to create an account in our website and logging in.


You are solely responsible for keeping your Helpdesk account username and password (if you have them) confidential and you are responsible for all activity that occurs under your account.


Nature of the service


The services are not of a legal or advisory nature and no responsibility is accepted for the results of any actions made on the basis of its services. The content and opinions expressed are those of the authors and do not necessarily represent the views of the European Commission and/or the Executive Agency for Small and Medium-sized Enterprises or any other body of the European Union.


Before taking specific actions in relation to IPR protection or enforcement all users are advised to seek independent advice. The European Commission and the Agency do not accept any responsibility for use that may be made of the information it contains.


Information


The Helpdesk team is commits its best efforts to keep the information updated and accurate for its users However, no guarantee can be made on the correctness or completeness of the information provided and neither the European Commission nor EASME nor the project partner are responsible for any lack of completeness or inaccuracy of the information contained herein. Nevertheless if you find information that may be misunderstood or that should be corrected please contact us at helpline@latinamerica-ipr-helpdesk.eu


Free-of-charge


All the Helpdesk services are provided under a free-of-charge basis. Therefore the Helpdesk would not require any payment, nor financial data (such as bank account) for using their services. In case someone contacts you on behalf of the Helpdesk requiring any kind of payment, please contact us by email to helpline@latinamerica-ipr-helpdesk.eu

All copyrightable text and graphics, the selection, arrangement, and presentation of all materials (including information in the public domain), and the overall design of this web page are ©2015 by the European Commision. All rights reserved.

Any other copying, distribution, retransmission, or modification of information or materials on this site, whether in electronic or hard copy form, without the express prior written permission of the European Commision, is strictly prohibited.

Any other Intellectual Property derived from the activities of the Helpdesk, including, but not limited to, trademarks, non-registered designs, domain names or databases are owned by the European Commission. Any of the partners of the Consortium, the European Commission and EASME are entitled to enforce or anyhow defence them against the misuse by third parties.


Inappropriate content


Without prejudice to the relevant legal actions, the Helpdesk will automatically remove any comment or content from its website, blog, social media or any other mean of communication that is considered inappropriate or illegal. Including those which:


  • contain offensive or violent text or images;
  • incite hate whether based on race, religion, gender, sexuality or otherwise, or promote, encourage or facilitate anti-social behavior;
  • promote, encourage or facilitate terrorism or other activities that risk national security;
  • discriminate against any specific social group or otherwise exploit vulnerable sections of society;
  • promote, facilitate or encourage illegal activity;
  • are misleading, defamatory, or that contain illegal, or otherwise actionable content under the applicable law; including those that might be perceived as damaging the Commission, EASME or the Helpdesk reputation
  • infringe individuals´ privacy

End of the services


The Commission, EASME or the Consortium are entitled to finish the services without prior notice in cases such as:


  • Misuse of the services by the user
  • Any use contrary to these terms or to the Applicable Law
  • End of the Project
  • Force Majeure
  • Other causes

The Commission, EASME or the Consortium is not responsible from any liability that may arise from the interruption of the service.


Continuity


If any part of the terms is found to be illegal, invalid or otherwise unenforceable by a court or regulator, then, where required, that part shall be deleted from the Terms and the remaining parts of the terms will continue to be enforceable.

Dispute


Without prejudice to International Jurisdiction and Competence applicable Law all disputes arising out of the terms will be governed by and interpreted in accordance with the laws of Spain and before Alicante Tribunals.
